Terms of Service

You must be at least the age of majority in your state or territory of residence to make a purchase. If you permit a minor to access the store through a device or account you control, you remain responsible for that access.

You agree to provide current, complete, and accurate information when placing an order or using store features. You are responsible for maintaining the confidentiality of account credentials and for activity performed through your account.

You may not use the store for an unlawful, fraudulent, misleading, abusive, or unauthorized purpose. Automated scraping, interference with store security, distribution of malicious code, and attempts to gain unauthorized access are prohibited.

SeaNova operates an online store serving customers in the United States. Store information, product availability, policies, and service features may be updated when reasonably necessary.

Submitting an order is an offer to purchase the listed products. An automated acknowledgment confirms receipt but does not by itself constitute acceptance. An order is accepted when SeaNova confirms processing or shipment.

SeaNova may refuse, limit, or cancel an order when reasonably necessary, including in cases involving suspected fraud, unauthorized payment, inaccurate product or pricing information, inventory limitations, shipping restrictions, or misuse of promotional offers.

If an order is canceled after payment has been authorized or collected, the applicable amount will be released or refunded to the original payment method. Processing times may vary by financial institution.

Prices are displayed in United States dollars unless otherwise stated. Applicable taxes and any other legally required charges are shown during checkout. You authorize SeaNova and its payment providers to charge the payment method submitted with your order.

Customers who successfully complete an eligible email subscription may receive an automatic fifteen percent sitewide discount. This benefit is not limited to a first order. Selected promotional products may receive an automatic twenty percent discount.

Promotion availability, eligible products, and combination rules are determined by the offer shown in the store or at checkout. Unless SeaNova expressly states otherwise, multiple discounts may not be combined on the same item.

SeaNova may correct accidental pricing, description, or promotional errors. If a correction materially affects an unfulfilled order, SeaNova may request confirmation or cancel and refund the affected item.

SeaNova provides free shipping on all products. Estimated delivery is three to five business days unless a different estimate is displayed for a particular order.

Delivery dates are estimates and are not guarantees. Weather, carrier disruptions, address issues, high-volume periods, public emergencies, and events outside reasonable control may affect delivery.

You are responsible for providing a complete and accurate delivery address. When tracking information shows delivery, responsibility for safely receiving and securing the package passes to the recipient to the extent permitted by law.

SeaNova offers free returns and exchanges for eligible products within thirty days after delivery. Products should be returned in their original condition with included components, accessories, manuals, and packaging when reasonably possible.

Proof of purchase may be required. Items showing misuse, unauthorized alteration, damage caused after delivery, or excessive wear may not qualify. Health, hygiene, and safety restrictions may apply to certain opened or used products when required by law or reasonable sanitation standards.

Approved refunds are issued to the original payment method. Replacement availability cannot be guaranteed. If a requested exchange item is unavailable, SeaNova may provide a refund or another available resolution.

SeaNova makes reasonable efforts to present product descriptions, colors, dimensions, materials, specifications, and images accurately. Screen settings, manufacturing variations, measurement methods, packaging changes, and product revisions may produce minor differences.

Product availability may change without notice. SeaNova may modify or discontinue products and may limit sales by person, household, geographic region, or order when reasonably necessary.

Before use, inspect every product and review all labels, manuals, warnings, sizing information, maintenance instructions, and compatibility requirements supplied with it.

You are responsible for determining whether a product is appropriate for your intended activity, location, physical condition, experience, and skill level. No product replaces sound judgment, training, supervision, or compliance with applicable law.

• Use an approved and properly fitted personal flotation device whenever required or appropriate.
• Check weather, tides, currents, water temperature, access rules, and local warnings before an activity.
• Do not use equipment while impaired or beyond its stated weight, capacity, pressure, depth, speed, or environmental limits.
• Children and inexperienced participants must receive appropriate adult supervision.
• Stop using any product that appears damaged, worn, incorrectly assembled, or unsafe.

SeaNova products may not be used for unlawful activity, unauthorized commercial operation, reckless conduct, or any purpose inconsistent with supplied safety instructions.

Store content, including branding, names, text, page layouts, graphics, photographs, videos, icons, product presentation, and other original materials, is owned by or licensed to SeaNova and is protected by applicable intellectual property laws.

SeaNova grants you a limited, revocable, nonexclusive, nontransferable right to access the store for personal, noncommercial shopping purposes. You may not reproduce, distribute, modify, publish, sell, license, create derivative works from, or commercially exploit store content without prior written authorization.

If you submit a review, photograph, idea, suggestion, or other nonconfidential material, you confirm that you have the right to provide it and that it is accurate, lawful, and does not violate another person's rights.

You grant SeaNova a worldwide, nonexclusive, royalty-free, transferable, sublicensable license to use, reproduce, adapt, publish, display, and distribute that submission for store operation, product presentation, customer service, and marketing, subject to applicable law.

SeaNova may remove submissions that are deceptive, unlawful, abusive, discriminatory, infringing, unrelated, or contain personal information that should not be publicly displayed.

Store operation may involve independent payment processors, carriers, technology providers, analytics services, or other third parties. Their services may be governed by separate terms and privacy practices.

SeaNova is not responsible for independent third-party sites, content, services, or conduct outside its reasonable control. Accessing a third-party service is at your discretion, and you should review the terms applicable to that service.

SeaNova processes personal information to operate the store, fulfill orders, provide requested services, prevent fraud, communicate about purchases, maintain security, and meet legal obligations.

Information may be shared with service providers when reasonably necessary for payment processing, delivery, technology operation, analytics, fraud prevention, and other legitimate store functions. Privacy rights and available choices depend on applicable law.

To the fullest extent permitted by law, the store and its services are provided on an “as available” basis. SeaNova does not guarantee uninterrupted access, error-free operation, universal product compatibility, or that every description will be free from minor inaccuracies.

Products are subject to any warranties expressly supplied by the manufacturer or required by law. Nothing in these Terms excludes warranties, rights, or remedies that cannot legally be excluded.

Water sports, swimming, boating, diving, towing, beach, pool, and outdoor activities may involve inherent risks. SeaNova does not provide professional medical, rescue, training, navigation, weather, or safety advice.

To the fullest extent permitted by law, SeaNova and its officers, employees, affiliates, licensors, and service providers will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages, including lost profits, lost data, or loss of opportunity, arising from use of the store or products.

Where liability cannot be excluded, SeaNova's aggregate liability arising from a claim related to a purchase will not exceed the amount paid for the product giving rise to that claim, except where applicable law requires a different remedy.

Some jurisdictions do not permit certain exclusions or limitations. In those jurisdictions, these provisions apply only to the maximum extent permitted by law.

To the extent permitted by law, you agree to indemnify and hold SeaNova and its affiliates, officers, employees, licensors, and service providers harmless from third-party claims, damages, losses, and reasonable costs resulting from your unlawful use of the store, violation of these Terms, infringement of another person's rights, or misuse of a product.

SeaNova may suspend or terminate access to store features when reasonably necessary to protect customers, enforce these Terms, investigate suspected fraud, respond to security threats, comply with law, or prevent harmful conduct.

Provisions concerning payment obligations, intellectual property, submissions, disclaimers, liability, indemnification, and governing law survive termination when their nature requires survival.

These Terms are governed by the laws of the Commonwealth of Virginia and applicable federal law, without regard to conflict-of-law principles.

Any dispute not resolved informally will be brought in a court of competent jurisdiction serving Virginia Beach, Virginia, unless applicable consumer law provides you with the right to proceed in another location.

Before filing a formal claim, the parties are encouraged to provide written notice of the issue and allow a reasonable opportunity to seek an informal resolution.

SeaNova may revise these Terms to reflect changes in the store, services, legal requirements, security practices, or business operations. The current version will display its effective date on this page.

Changes apply after publication unless a later date is stated. If a change materially affects an existing right or obligation, SeaNova will provide any notice required by applicable law.

Continued use of the store after revised Terms take effect constitutes acceptance of the revised Terms to the extent permitted by law.
